According to the waste management legislation all the companies have to keep track of the generated waste and fill in specific reports to the National Environmental Protection Agency with monthly, semiannual or annual frequency depending on the activity carried out

The National Environmental Protection Agency (NEPA) ensures a proper waste management system for the safety and protection of the environment and of the health of the population. It is subordinated to the Ministry of the Environment, Waters and Forests and has attributions in the implementation of environmental laws and policies at national and local level, as well as reporting to the European Environment Agency.

A proper waste management system is mandatory and is carried out through an efficient waste recovery, starting with the separate collection of at least for the following categories of waste: paper, metal, plastic and glass. It is forbidden to mix different categories of waste, each of them having a specific degree of dangerousness.

THE LEGALLY REQUIRED NEPA REPORTS ARE:

  • Monthly, quarterly or half-yearly reporting of waste generated, according to the environmental permit or the law requirements
  • Reporting in IEM the waste generated and / or collected
  • Half-yearly reporting of waste oils
  • Annual reporting to EPA of electrical and electronic equipment waste collected
  • Annual reporting of used batteries collected, until the 28th of February for the previous year
  • Reports regarding the management of used tires
  • Reports regarding environmental factors monitoring (water, air, ground/underground, noise and vibration)
  • Annual reporting of the waste quantities introduced on the market to the Environmental Protection Agency

IEM REPORTING

For a more efficient data collection NEPA has developed an online “e-form” platform, consisting of an online registration form named Integrated Environmental System (IEM), accessible at www.raportare.anpm.ro.

Following the proposal from the European Commission addressed to EU member countries and the announcement of the NEPA (National  Environmental Protection Agency ), starting on the 10th of April 2013, all economic operators / individuals requesting the issuing or reviewing environmental permits need to do so both in the classical format – on paper, and online, through the IES – Integrated Environmental System. This is also where the data / environmental reporting is sent, for all segments: Hazardous Substances, Waste, Biosecurity, Sustainable Development, Industrial Emissions, Regulations (notices, agreements, permits), Ground / Underground s.a.

REPORTING OBLIGATION

The following legal entities are obliged to report in SIM: waste generators, waste holders, traders and brokers, economic operators authorized to carry out collection / treatment / recovery / disposal activities of waste, sanitation operators, the local public administration, etc.

The registration is performed individually, for each work point / location of the economic operator. By accessing the link https://raportare.anpm.ro/irj/portal/public you can begin the registration procedure, following which you will receive the authentication data (a unique User and Password combination) to be used for your account. As a security and confidentiality measure, SIM password will have to be changes from time to time.

Online reporting starts when the National Environmental Protection Agency or the local Environmental Protection Agencies sends an e-mail to the operators, notifying them that the reporting session has been open, thus reports can be introduced in the SIM until the deadline imposed by the environmental authority. After this deadline, any amendment or completion can only be performed by sending a message to suportsim@anpm.ro or by phone call at the National Environmental Protection.Agency.

In order to fill in an environmental report, after authentication, the economic operator will send an access request for that form (for example: completing the reporting by the waste generators.), without which he cannot perform the registration of the data included in that respective reporting. To access this specific report you need to follow the following the steps: Profile -> Access account requests -> Waste -> PRODDES (Data collection regarding waste generation and waste management).

Law complying failure attracts fines up to 1.000 lei, for individuals and up to 20.000 lei for legal entities.
