THE NECESSARY DOCUMENTATION AND FILLING IN THE MONTHLY STATEMENT TO EFA

The legislative framework regulating the management of packaging and packaging waste in order to prevent or mitigate the environmental impact is defined by Law no. 249/2015 on the management of packaging and packaging waste. According to the legal obligations, all economic operators need to regularly fill in a series of reports regarding the evidence of newly introduced packaging on the Romanian market, both from the manufacturing and import activity.

The companies which have the legal obligation of reporting the packaging introduced on the market are: the economic agents who introduce packaged goods in Romania (as manufacturers or importers), those who are over-packaging goods, with resale/redistribution purposes, and those introducing retail-packaging. They are responsible for the waste generated by the primary, secondary and tertiary packaging used, information included in the monthly statements to EFA.

PACKAGING MARKING SYSTEM

Packaging manufacturers must also use a system for packaging marking and identification, therefore streamlining the process of recovering and recycling packaging waste.

According to the legislation, all types of packages need to be reported and we need to start with their correct identification and classification. Law complying failure attracts fines varying from 500 lei to 1.000 lei, for individuals and from 1.000 lei to 5.000 lei, for legal entities, according to 31/2013 ordinance.

EFA STATEMENT

The monthly EFA statements are filled in in online and in order to complete them you will require the data regarding the quantity of packaging placed on the Romanian market. Even if in a specific month no packing will be placed on the market the statement still needs to be filled in with amount zero.
