Environmental Compliance Audit

It is extremely important to periodically check if you comply with the environmental legislative requests in order to avoid penalties/fines that can be applied and also to assure a proper image in relation to customers/suppliers which are paying more attention to reduce the ecological footprint.

The environmental audit is not a legislative request by itself but it is voluntarily carried out by the companies who are environmental responsible in order to identify if they comply with the legislation and improve the environmental performance.

The environmental compliance check represents a complex process through which the auditors conduct an assessment on the current situation regarding the activities with environmental impact, the compliance with the legislation, the technological process and the existing documents identifying the nonconformities ad proposing solutions to comply with the legislation, prevent and mitigate or reduce the environmental impact.

According to Green Environment Support procedure we first start by establishing the evaluation team depending on the activity carried out (industry, commerce, waste management), and jointly agree with the beneficiary the areas/technological processes and documents needed, the visit in the workspaces and last but not least check if all legislative requirements are met.

The team of auditors contains usually 2 persons and can be extended with specialists from various domains depending on the complexity of the activities assessed

During the assessment of the location we identify the following: the technological processes with potential impact on the environment, raw materials acquisitions, the type of waste generated. the areas where the waste is generated and temporary stored, the hazardous waste storage, the type and quantity of packaging placed on the market, the pollution/dispersion installations, the type of products.

Regarding the assessed documents during the compliance audit performed by Green Environment Support we can mention:

  • Company documents to check the NACE codes declared to Trade Register    for the working point and establishing the necessity to obtain the environmental permit
  • Updated utilities contracts (water supply, sewerage, gas supply, generated waste);
  • Regulatory acts (environmental agreement and permit, water management permit, water discharge agreement) to identify the obligations to monitor and report to the authorities
  • Control reports issued by the competent authorities in the field of environmental protection (NEG, Local Police, EFA, etc.) to identify the measures imposed and whether these measures were met on time
  • Various registrations requested by the law (registration in the Register of importers / producers of batteries / accumulators / electrical and electronic equipment)
  • Environmental responsible nomination
  • Company’s registration in the Integrated Environmental System (SIM) and all online reports
  • Monthly evidence of the generated waste for each waste code according to the legislation
  • Annual waste evidence report registered to APM
  • Packaging and waste packaging report registered to APM
  • Hazardous substances list registered to ITM and APM
  • Hazardous substances evidence
  • Technical data sheet of the chemical substances handled
  • Transportation forms (Annex 1 for hazardous waste transportation over 1tone/year, Annex 2 for waste collection, Annex 3 for dangerous waste)
  • Evidence of the oils produced/imported, and generated/collected/ recovered/eliminated used oils
  • Evidence of batteries / accumulators produced / imported
  • Evidence of new/used tires who are destinated to be reused
  • The annual balance of solvents (specially for dry cleaning, printing activities, surface cleaning, shoes manufacturing, paint manufacturing)
  • Accidental pollution prevention plan
  • Test reports for the indicators from the environmental permit, discharge water agreement, water management permit

A part of the compliance audit can be the waste management audit which is followed by a waste reduction and prevention plan according to the legislation in force.

  • The site assessment (waste storage, technological process, hazardous substances storage)
  • Specific documents check (waste collectors’ contracts, environmental permits, Annex1/Annex2/Annex3)
  • Identifying the type of generated waste
  • Identifying the recovery/elimination operations for the generated waste
  • Legislation assessment
  • Identifying the selective waste collection solutions or collectors for all types of generated waste
  • Drafting the audit report and the waste reduction and prevention plan

The following information can be requested in order to assess the fulfillment of the annual recycling/ recovery objective for the waste resulted from the packaging placed on the market and the compliance with the Environmental Fund Administration:

  • Tables/evidences/data base regarding the products placed on the market (packaged products and the type of packaging, tires, mineral oils, electric and electronic equipment and batteries), atmospheric emissions and stationary sources
  • the documents that can be taken into account to determine the packaging, tires, electric and electronical equipment weight and as well the one for batteries
  • traceability files regarding the assurance of the fulfillment of the annual recycling/ recovery objective

According to the up-dates of law 211/2011 the manufacturers or the organizations who implement the extended responsibility of the manufacturer need to have implemented an internal audit or an independent audit to evaluate the quality of the reported data including the requests of CE Regulation nr 1.013/2006 of the European Parliament and the Council from June 14th 2006 regarding the transfer of waste with the subsequent changes.

The site assessment and the document check are done according to the law in force for each field of activity depending on the environmental impact (waste management, Environmental Fund Administration, oils, tires, electrical equipment, chemical substances, solvents).

For each noncompliance point identified the risks are analyzed and the mitigation plan is put in place.

Among the most important risks for a company who doesn’t know it’s obligations are the financial ones due to the fact that fines can be applied or penalties who can reach up to tens of millions or service interruption until the non-conformities are corrected.

After identifying the specific environmental aspects, the noncompliance aspects and risks, the assessment team identifies the best solutions and propose the measures to be taken by the client in order to mitigate, prevent and eliminate the associated risks and reduce the costs in terms of resources and waste management.
